Brainix USA LLC and its subsidiaries and affiliates (collectively, "Brainix," "we," or "us") understand that your privacy is important to you. We are committed to respecting your privacy and protecting your personal data, which consists of any information capable of identifying you as an individual. This Privacy Policy describes how we handle and protect your personal data in relation to Brainix's business activities, such as conferences and events, and services provided to clients, as well as on websites, apps, and communications that contain a link to this Privacy Policy (collectively, "the Sites"), in our capacity as data controllers. Information We Collect

Brainix collects personal data in the course of its business activities, including in connection with some services provided to clients. We also collect personal data in certain areas of the Sites when you register or apply for positions through Brainix's Recruitment Portal, create a user profile, sign up to receive Brainix newsletters and alerts, participate in our alumni activities through our Alumni Center website, register for conferences and events, and/or participate in public user-posted areas (such as bulletin boards, discussion forums, and surveys). The personal data collected may vary and may include information you provide, such as your name, mailing address, email address, phone number, fax number, and background information needed to apply for a job.

We may also automatically collect information about the devices you use to interact with our Sites. Information we automatically collect may include IP address, device identifier, web browser, and browsing information collected through cookies, web beacons, pixels, clear gifs, and other similar tracking technologies (collectively, "Cookies and Other Tracking Technologies") on our Sites. We may also automatically collect information about how you use the Sites, such as what you have searched for and viewed on the Sites. The information collected automatically may be associated with a unique identifier, as well as with any other personal data you have provided.

Brainix may also collect personal data about you from third parties, such as data brokers or aggregators, in the course of its business activities, including in connection with some services provided to clients. This includes demographic, professional, and other publicly available online information, including information you have chosen to make publicly available through social media platforms and other online public forums. We may combine this data with information we already have about you or use it independently for purposes such as our benchmarking and data analysis activities (e.g., analyzing recruitment practices in an industry, detecting fraud patterns in financial transactions, foot traffic in retail environments). We will always seek to confirm that the third party has provided transparent information about the use of this data, including its disclosure to third parties like Brainix, in compliance with applicable laws.

Use of information

Brainix uses your personal data to fulfill your requests for information, process your requests to attend conferences and events, personalize the content you view or receive on the Sites, assess and improve our services, distribute newsletters and alerts, recruit and evaluate job applicants, analyze the performance and functioning of the Sites, publish your letters to the editor or comments, prevent fraud, enforce our terms of use, comply with all applicable laws and corporate reporting obligations, enforce Brainix agreements, and fulfill other purposes you may initiate or request. In some situations, the collection of personal data may be necessary for the operation of the Sites, or we may use them in the course of our business activities, including in connection with some services provided to clients, for example, to provide certain services or products such as our benchmarking products. We may combine and/or analyze personal data to assess and provide you with more relevant content and services. We may keep any of your personal data on file and use them to contact you.

Brainix and its service providers may use first-party and third-party Cookies and other Tracking Technologies, including web beacons, to manage our Sites and our services and collect analytics about how you use them. Brainix and its service providers may collect information about whether you have opened or clicked on links in the knowledge, research, or event communications we send to you. The information provided in this Privacy Policy about cookies also applies to these other tracking technologies. Our Sites do not track your online activities over time on third-party websites or online services by collecting personal data. Consequently, we do not change our data collection and use practices in response to "Do Not Track" signals transmitted by web browsers.

Use of information collected through mobile devices

In connection with our mobile applications, Brainix may use third-party service providers to analyze user activity, fix errors, monitor usage, and improve the performance of mobile applications. For example, Brainix receives reports on aggregated usage and browsing patterns from some of our mobile applications, including information about the type of device used, articles accessed, and other events occurring within our applications. Brainix also receives reports on certain errors that occur in mobile applications.

Additionally, our Brainix Insights app offers a personalized list of recommendations (called "Insights for you") that directs you to Brainix content we think you'll find interesting. Recommendations are based solely on what you have viewed in the Insights app. A unique user identifier generated by the app helps personalize your experience in the app and tracks the articles you read within it. We do not share your viewing history or trends through the Insights app with other users or any external third parties (i.e., individuals or entities not affiliated with Brainix or third-party service providers of Brainix).

The legal basis on which we process your personal data

Our processing of your personal data for the purposes mentioned above is based:

in part, on your consent, for example, if you create a user profile, subscribe to our newsletters or alerts, or for business purposes that support web operations, such as understanding and improving the quality of your experience on our sites;

  • in part, to comply with the law, when certain information is necessary to meet our legal or regulatory obligations.

  • in part, on our legitimate interests in promoting and protecting Brainix, building and maintaining relationships, recruitment, and providing our services;

  • in part, on your consent, for example, if you create a user profile, subscribe to our newsletters or alerts, or for business purposes that support web operations, such as understanding and improving the quality of your experience on our sites;

  • in part, to comply with the law, when certain information is necessary to meet our legal or regulatory obligations.

Disclosure of Personal Data: Data Recipients and International Data Transfers

Personal data collected in the course of Brainix's business activities, including in connection with some services provided to customers, as well as on the Sites, may be transferred from time to time to Brainix subsidiaries and affiliates and their employees throughout our global organization, as well as to our third-party service providers located around the world, including in countries where local laws may provide less protection to you than you have in your own country. Furthermore, the Sites may be viewed and hosted by Brainix and our third-party service providers anywhere in the world. Where required by law, we have implemented legal mechanisms designed to ensure adequate protection of your personal data that is processed by Brainix subsidiaries, affiliates, and third-party service providers, including the transfer of your personal data to countries different from the one in which you reside. By using any of the Sites and providing information on any of them, you voluntarily consent to the cross-border transfer and hosting of such information.

Brainix will not intentionally disclose or transfer (and will take reasonable steps to prevent the unauthorized or accidental disclosure of) your personal data to third parties without your consent or as otherwise permitted by law, whether for such third parties' own marketing purposes or otherwise, except as follows. Brainix may permit third-party service providers to access your personal data contracted by Brainix to provide services related to the Sites as well as related to Brainix's business activities, including in connection with some services provided to customers, in the manner agreed in our customer services contracts. We maintain processes designed to ensure that any processing of personal data by third-party service providers is in compliance with this Privacy Policy and protects the confidentiality, availability, and integrity of your personal data.

We may also share your personal data with third-party service providers who perform services and functions on our behalf to support our interactions with you, including, for example, processing recruiting materials, administering surveys or contests, or communicating with you.

Additionally, we may disclose information about you:

  • If we are required to do so by law or legal process;

  • To law enforcement authorities or other government officials;

  • When we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity;

  • If disclosure is necessary to protect the vital interests of a person;

  • To enforce our terms of use;

  • To protect our property, services, and legal rights;

  • To prevent fraud against Brainix, our subsidiaries, affiliates, and/or business partners;

  • To support audit, compliance, and corporate governance functions; or

  • To comply with all applicable laws.

Furthermore, we may disclose or transfer your personal data in the event of a reorganization, merger, sale, joint venture, assignment, or other transfer or disposition of all or part of our business.

User Forums

You should be aware that whenever you disclose information online in a public forum, that information can be collected and used by other people. Brainix is not responsible for any action or policy of third parties who collect information that users publicly disclose on such forums on the Sites.

Link to Third Party Sites

Brainix may provide links to third-party websites or information as a service to our users. If you use these links, you will leave the Sites. Such links do not constitute or imply endorsement, sponsorship, or recommendation by Brainix of the third party, the third-party website, or the information contained therein, and Brainix shall not be responsible for your use thereof. Such use will be subject to the terms of use and privacy policies applicable to those sites.

Social media

The Sites may allow you to log in and link your social media accounts, including but not limited to Twitter, LinkedIn, Facebook, and YouTube, to Brainix. The Sites may also allow you to log in to a Brainix account using certain social media account credentials.

By linking your social media account to Brainix or logging in to a Brainix account using your social media account credentials, you give us permission to access the information you have made available in your public profile for that social media account. The information available in your public profile varies by social media network and your settings, but may include your email address, real name, profile picture, gender, and location. We use the information we receive from your social media account in accordance with the terms of use of the social media network and this Privacy Policy. Please refer to the privacy settings in your social media account for information on what data is shared with Brainix and other connected apps, as well as to manage the data shared through your account, including information about your activities using our Sites.

If you wish to disconnect a social media account from us, please refer to the settings of that social media account and your provider.

Security

Brainix has implemented generally accepted technology and operational security standards to protect personal data against loss, misuse, alteration, or destruction. Only authorized personnel of Brainix and third-party service providers have access to personal data, and these employees and service providers are required to treat this information as confidential. Despite these precautions, Brainix cannot guarantee that unauthorized individuals will not gain access to your personal data.

Data Retention

A Brainix retains personal data as necessary during the relevant business relationship period.

We may also retain personal data for a longer period than the duration of the business relationship if we need to retain it to protect against legal claims, use it for analysis or historical record-keeping, or comply with our information management policies and schedules. If you request the deletion of your personal data, Brainix will make reasonable efforts to delete all instances of the information in its entirety. For requests for access, corrections, or deletions, please refer to the "Your Rights" section of this Privacy Policy.

Children

The Sites are not designed for or directed at children who are 16 years old or younger, and Brainix does not intentionally collect or maintain personal data from anyone of that age.

Brainix Recruitment Portal

Through the Brainix Recruitment Portal, you can apply for positions at Brainix or sign up for a Brainix recruitment program where you may be notified about potential job openings or similar opportunities of interest. The Recruitment Privacy Notice provides more detailed information on how Brainix and its subsidiaries and affiliates handle and protect personal data collected during the recruitment process.

If you are a former employee of Brainix, you may be eligible to participate in our alumni program and have access to support tools and training for employees and partners.

Your rights

When granted by applicable law, you may have the right to request access to the personal data we collect about you for the purpose of reviewing, modifying, or requesting the deletion of the data. You may also have the right to request a copy of the personal data we collect about you and correct any inaccuracies in that data. In certain circumstances, you may also request that we cease processing your personal data.

If you wish to make a request for access, review, or correction of the personal data we collect about you or discuss how we process your personal data, please contact us via email at sales@brainixusa.com. To protect your privacy and security, we will take reasonable steps to verify your identity, such as requiring a password and user ID, before granting access to your personal data. We will make reasonable attempts to investigate, comply with, or respond promptly to your requests, as required by applicable law. Different laws may prevent us from providing access to your personal data or fully complying with your request, depending on the circumstances and the request, such as when producing your information may reveal the identity of another person. We reserve the right to charge an appropriate fee to fulfill your request where permitted by applicable law and/or deny your requests if they are manifestly unfounded, excessive, or otherwise questionable or unjustified under applicable law.

Additionally, and where granted by local law, you have the legal right to file a complaint with a competent data protection authority.

We may update this Privacy Policy periodically to reflect changes in our information practices. We will post an updated copy of the Privacy Policy on our Sites. We recommend that you periodically check the Sites for the most up-to-date versions of our Privacy Policy.
